This website, us.thethermolab.com (the "Site"), is operated by ThermoLab LLC, a Wyoming limited liability company ("ThermoLab", "we", "us" or "our"). These Terms of Service ("Terms") apply when you visit the Site or buy from us. By using the Site or placing an order, you agree to these Terms, so please read them carefully.

1. Who can buy

The Site is intended for customers in the United States. You must be at least 18 years old, or the age of majority where you live, to place an order. We currently only ship to addresses in the United States.

2. Our products and safe use

ThermoLab steam saunas, red light therapy panels and accessories are general wellness products for personal, at-home use by adults. They are not medical devices and are not intended to diagnose, treat, cure or prevent any disease. Statements on the Site have not been evaluated by the Food and Drug Administration. Talk to your doctor before use if you are pregnant, have a medical condition, have an implanted medical device, take medication that affects your sensitivity to heat or light, or have any concerns about your health. Always follow the instructions and safety warnings that come with your product, including the recommended session times, distances and use of the supplied goggles.

3. Orders

When you place an order, you're making an offer to buy. We'll email you an order confirmation, which means we've received your order, not that we've accepted it. Your order is accepted when we ship it and send you a shipping confirmation. We may decline or cancel an order, for example if a product is unavailable, a price or description contains an error, we can't verify your payment, or we suspect fraud. If we cancel an order you've paid for, we'll refund you in full.

4. Prices and payment

All prices are in US dollars. Sales tax is added at checkout where state law requires it. We accept the payment methods shown at checkout. Payments are processed securely by Shopify Payments and our payment partners; we don't store your full card details. If you choose a pay-later option such as Klarna or Shop Pay Installments, that provider's own terms also apply to your plan.

Discount codes and promotions can't be combined unless we say they can, apply only while the offer is running, and may be withdrawn at any time. Products marked "Coming soon" can't be bought until they are released.

5. Shipping, returns and warranty

Delivery, returns, refunds and our 3-year limited warranty are explained in our Shipping Policy and Return and Refund Policy, which form part of these Terms. Risk of loss passes to you when the product is delivered to your shipping address.

6. Accuracy of information

We work hard to keep product descriptions, images, specifications, prices and availability accurate, but mistakes can happen and colors can look different on different screens. We may correct errors and update information at any time. If we find an error affecting an order you've already placed, we'll contact you and you can cancel for a full refund.

7. Reviews and content you share

If you submit reviews, photos, videos or comments, you confirm they're your own, honest and accurate, and don't infringe anyone else's rights. You give ThermoLab a non-exclusive, royalty-free, perpetual license to use, reproduce, edit and publish that content in connection with our business. We may remove content at our discretion.

8. Using the Site

You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its security or operation, scraping it with automated tools, or using it for anything unlawful or fraudulent.

9. Intellectual property

ThermoLab, AuraCore™, Aura™ and all text, images, videos, logos and other content on the Site are owned by or licensed to ThermoLab LLC and protected by US and international intellectual property laws. You may not copy, reproduce or use them without our written permission.

10. Third-party links and services

The Site may link to or use third-party websites and services. We're not responsible for their content, policies or practices, and your use of them is at your own risk.

11. Disclaimer

Except for the express warranty in our Return and Refund Policy, and to the extent permitted by law, the Site and its content are provided "as is" and "as available". We don't promise that the Site will always be available, uninterrupted or error-free.

12. Limitation of liability

To the fullest extent permitted by law, ThermoLab LLC will not be liable for any indirect, incidental, special, punitive or consequential damages arising out of your use of the Site or our products, and our total liability for any claim will not exceed the amount you paid for the product involved. Nothing in these Terms limits any liability that can't be limited by law, or your rights under applicable state consumer protection laws. Some states don't allow certain limitations, so some of these limits may not apply to you.

13. Indemnity

You agree to indemnify and hold ThermoLab LLC harmless from claims arising out of your breach of these Terms or your misuse of the Site or our products, to the extent permitted by law.

14. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules, except where the law of your state of residence requires otherwise. If something goes wrong, please email us first at info@thethermolab.com. We resolve almost everything quickly and fairly. Any dispute we can't resolve informally will be brought in the state or federal courts located in Wyoming, unless the law of your state gives you the right to bring it where you live. You may also bring an individual claim in small claims court in your county where it qualifies.

15. Changes to these Terms

We may update these Terms from time to time. The version posted on the Site when you place your order applies to that order.
